تدابير الضبط الإداري للمحافظة على الصحة العامة و مواجهة إنتشار جائحة كوفيد -19- في الجزائر

Abstract

الملخص : لقد تناولنا في دراستنا هذه كل مايخص موضوع تدابير الضبط الإداري للمحافظة على الصحة العامة و مواجهة إنتشار جائحة كوفيد 19 في الجزائر و ذلك من خلال الإشكالية الرئيسية بصياغة: ماهي تدابير الضبط الإداري في مواجهة جائحة كوفيد 19 في الجزائر؟ وقد تطرقنا في الشق الأول من الدراسة إلى ماهية الضبط الإداري من خلال تعريفه و تحديد طبيعته و من ثم تمييزه عن باقي نظم الضبط الأخرى، و الذي يهدف بصفة عامة إلى الحفاظ على النظام العام بعناصره التقليدية التي لم يعد يقتصر عليها هي فقط بل إتسع ليشمل عناصر أخرى حديثة . أما بالنسبة للشق الثاني فقد تعرضنا فيه إلى إجراءات الضبط الإداري في الحد من إنتشار وباء فيروس كورونا، إذ نجد أن المشرع قد حدد هيئات الضبط الإداري على المستوى الوطني و المحلي، و للتصدي لوباء فيروس كورونا إعتمدت الدولة على أليات الضبط الإداري في مجال الصحة العامة من خلال إتخاذ وسائل قانونية و مادية لمواجهة هذا الوباء في الجزائر.

Résumé : Dans notre étude, nous avons abordé tout ce qui touche au sujet des mesures de contrôle administratif pour maintenir la santé publique et faire face à la propagation de la pandémie de Covid 19 en Algérie, à travers le problème principal en formulant : Quelles sont les mesures de contrôle administratif face à la pandémie de Covid 19 en Algérie ? Dans la première partie de l'étude, nous avons abordé la nature du contrôle administratif en le définissant et en déterminant sa nature, puis en le distinguant du reste des autres systèmes de contrôle, qui vise en général à préserver l'ordre public avec ses éléments traditionnels. , qui ne se limite plus à lui seul, mais élargi pour inclure d'autres éléments modernes. . Quant à la deuxième partie, nous y avons évoqué les procédures de contrôle administratif pour limiter la propagation de l'épidémie de virus Corona, si nous constatons que le législateur a précisé les organes de contrôle administratif aux niveaux national et local, et pour lutter contre le virus Corona épidémie, l'état s'est appuyé sur les mécanismes de contrôle administratif dans le domaine de la santé publique Prendre des moyens juridiques et matériels pour faire face à cette épidémie en Algérie.
