Abstract

ملخص: إن تمويل المحكمة الدولية الجنائية مسألة معقدة بالنظر لما يؤثر به التمويل على سير هذه المؤسسة القضائية لضمان عدم الإفلات من العقاب في الجرائم الدولية ، حيث ينقسم التمويل حسب مصادره إلى نوعين الأول إجباري والثاني طوعي تبرعي ، وكلا المصدرين لهما تأثير مباشر وغير مباشر على استقلالية قضاء المحكمة الدولية الجنائية ، ويفرض هذا الشكل من التمويل وصاية مالية لبعض القوى السياسية الكبرى في العالم يصل حد الاستغلال السياسي لقضاء المحكمة ، عن طريق التحكم في ميزانية المحكمة والتوزيع غير العادل لمبالغ الاشتراكات بين مختلف الدول

Résumé : Le financement de la Cour pénale internationale est une question complexe au vu de l'impact du financement sur le fonctionnement de cette institution judiciaire et pour garantir l'impunité des peines dans les crimes internationaux. Lorsque le financement est divisé selon ses sources en deux types, le premier est obligatoire et le second est volontaire. Les deux sources ont un impact direct et indirect sur l'indépendance du pouvoir judiciaire de la CPI. Cette forme de financement impose la tutelle financière de certaines des grandes puissances politiques du monde, jusqu'à l'exploitation politique du pouvoir judiciaire de la Cour. En maîtrisant le budget du tribunal et la répartition inéquitable des contributions obligatoires .

Summary: The financing of the international criminal court is a complex issue in view of the impact of funding on the functioning of thisjudicialinstutition and to ensure the impunity of punishment for international crimes, as fundingisevaluatedaccording to its sources intotwo types ; the first iscompulsory and the second isvoluntary , and both sources have a direct and indirect impact on the independence of the judiciary the international criminal court , and thisform of financing imposes financialguardianship of some of the major politicalpowers in the word, up to the political exploitation of the court'sjudiciary by controlling the court's budget and the unfair distribution of the sums of money.
