Abstract

ملخـــــص البحـــــــث: هذه الدراسة تبين الأهمية والمكان التي يتبوأها قاضي تطبيق العقوبات من خلال ممارسة صلاحيته التي خولها له المشرع خاصة في مجال الإفراج المشروط بعدما عرفت جميع التشريعات العالمية تطورا في مجال في حماية حقوق وحريات المحكوم عليه بعد قضائهم مدة من العقوبة وإثباتهم إمكانية إعادة دمجهم من جديد في المجتمع

Résumé : Cette étude montre l'importance et la place que prend le juge d'application des peines en exerçant son autorité que le législateur lui a conféré, notamment dans le domaine de la libération conditionnelle après que toutes les législations internationales aient connu une évolution dans le domaine de la protection des droits et libertés du condamné après avoir purgé une peine et en démontrant la possibilité de le réinsérer dans la société. .
