لطالما سعى المجتمع الدولي إلى إنشاء قضاء دولي جنائي لمتابعة مرتكبي الجرائم الدولية، وفي سبيل ذلك مر بالعديد من المحاولات بدء من محاكم الحرب العالمية الثانية لكل من نورمبورغ وطوكيو، لتليهما محكمتا يوغوسلافيا ورواندا المنشئتان بموجب قرار من مجلس الأمن في إطار الفصل السابع من ميثاق الأمم المتحدة، وظلت هذه المحاولات إلى غاية 1998 أين تم بعث المحكمة الجنائية الدولية كأول جهاز قضائي دائم، يختص بمتابعة مرتكبي الجرائم الدولية الأكثر خطورة سعيا لتحقيق العدالة الجنائية الدولية والتي دخلت حيز النفاذ سنة 2002.
إلا أن المجتمع الدولي لم يكتف عند هذا الحد بل لجأ إلى استحداث محاكم دولية جنائية خاصة بتدخل من الأمم المتحدة على غرار محكمتي سيراليون ولبنان الخاصتين، مبررا ذلك بسبب القيود الواردة على النظام الأساسي للمحكمة الجنائية الدولية خاصة فيما يتعلق بالاختصاص. Abstract: : The international community has always sought to establish an international criminal judiciary to pursue perpetrators of international crimes, and for that it has gone through many attempts, starting with the Second World War tribunals in Nuremburg and Tokyo, followed by the courts of Yugoslavia and Rwanda established by a Security Council resolution under Chapter VII of the charter of the United Nations, These attempts remained until 1998 when the International Criminal Court was established as the first permanent judicial body specialized in following up the perpetrators of the most serious international crimes in pursuit of international criminal justice which entered into force in 2002: The International community was not satisfied with this but rather He resorted to creating international special criminal courts under the intervention of the United Nations similar to the Special Courts for Sierra Leone and Lebanon, justifying this because of the restrictions contained in the statute of the international criminal court especially with regard to jurisdiction. . Résumé La communauté internationale a toujours cherche a établir une justice pénal internationale pour poursuivre les auteurs de crimes internationaux et pour cela elle a subi de nombreuses tentatives. A commencer par les tribunaux de la seconde Guerre mondiale a Nuremberg et a Tokyo. Suivis par les tribunaux de Yougoslavie et du Rwanda établis par une résolution de conseil de sécurité dans le cadre du chapitre VII de la charte des Nations Unies. Ces tentatives se sont poursuivies jusqu’ en 1998 date a laquelle la cour pénal internationale a été crée en tant que premier organe judiciaire permanent spécialisé dans le suivi des auteurs des crimes internationaux les plus graves en poursuite de la justice pénale internationale. entrée en vigueur en 2002. La communauté internationale ne s’est pas contentée de cela. Mais a plutôt eu recours a la création de tribunaux pénaux internationaux spéciaux avec l’intervention des Nations Unies à l’instar des tribunaux spéciaux de la Sierra Leone et du Liban justifiant cela en raison des restrictions contenues dans le statut de la cour pénale internationale notamment en matière de compétence. |
