الآليات الدولية لمكافحة الاتجار بالمخدرات وتطبيقاتها في القانون الجزائري

Abstract

الملخص: إن السياسة الجنائية الحديثة تؤكد على ضرورة إتباع تدابير وقائية تساعد على إيجاد حياة خالية من المواد المخدرة حيث أن الإستراتيجية الدولية لمكافحة الاتجار غير المشروع بالمخدرات، تقوم على مجموعة من الآليات ذات الطبيعة الرقابية المنظمة لكيفية التعامل المشروع بالمخدرات ،وآليات تطبيقية تستهدف مكافحة جميع صور الاتجار غير المشروع وقد تبنى المشرع الجزائري معظم التدابير المنصوص عليها في الاتفاقيات الدولية من خلال مصادقته على الاتفاقيات السارية المفعول في إطار مكافحة الاتجار بالمخدرات . إن ما يميز الاتفاقيات الدولية في مجال مكافحة المخدرات احتوائها على جانبين الأول تنظيمي وهو ما تميزت به الاتفاقية الوحيدة للمخدرات لسنة 1961 بصيغتها المعدلة ببروتوكول 1972، وكذلك اتفاقية المؤثرات العقلية لسنة 1971 وجانب ردعي تميزت به اتفاقية فيينا 1988 حيث سعت إلى وضع حد للاتجار غير المشروع بالمخدرات . وقد جاءت هذه الدراسة في فصلين يتناول الأول الآليات الدولية ذات الطابع الوقائي لمواجهة الاتجار غير المشروع بالمخدرات والثاني يتناول الآليات الدولية ذات الطابع التطبيقي لمكافحة الاتجار غير المشروع بالمخدرات ثم انهينا بحثنا بخاتمة تضمنت أهم النتائج والتوصيات. Résumé La politique pénale moderne met l'accent sur la nécessité de suivre les mesures préventives aidant à créer une vie sans substances drogués. La stratégie internationale de lutte contre le trafic de drogue, basé sur un ensemble mécanismes de contrôle et de prévention. Mais aussi la lutte contre toute forme de commercialisation illégale. Le législateur algérien a adopté la plupart des mesures prévues dans les conventions internationales par le biais de l'approbation des accords applicables en vigueur dans la lutte contre le trafic de drogue. La caractéristique des conventions internationales dans le domaine de la lutte anti-drogue contenant les deux aspects essentiels l’un est organisationnelle qui caractérise la Convention unique sur les stupéfiants de 1961, modifiée par le Protocole de 1972, ainsi que la Convention sur les substances psychotropes de 1971, l’autre aspect est de caractères dissuasif contenant dans la convention de Vienne en 1988, où il est question d’essayer de mettre fin au trafic illicite de drogue. Notre étude est divisée en deux parties, le premier traite de la nature préventive des mécanismes internationaux pour faire face à la drogue et le second traite les mesures appliquée pour lutter contre le trafic illicite de drogues, puis nous avons terminé en donnant des résultats et recommandations à la fin de la recherche. - Abstract Modern penal policy emphasizes the need to follow the preventive measures help create life free of substance that the international strategy against drug trafficking, based on a set of natural regulatory body, how to manage Drugs project mechanisms, and practical mechanisms to combat all forms of trafficking Algerian law project adopted most of the measures provided for in international conventions through the approval of the applicable agreements in the fight against drug trafficking.
