Abstract

الملخص: إن نظام قاضي التحقيق في التشريع الجزائري هي هيئة قضائية خولها المشرع بسلطات واسعة على إجراءات التحقيق الابتدائي وبموجبها تعتبر درجة من قضاء التحقيق فهي تلعب دور المصفاة التي لا تمر عبرها إلا القضايا المهيأة للفصل فيها. وقد أسند المشرع الجزائري مهمة التحقيق الابتدائي إلى قاضي التحقيق كدرجة أولى في المواد الجزائية. كما أن صلاحيات هذا القاضي يشكل في الواقع جهاز قضائي قائم بحد ذاته و لقد مكنه المشرع من وظيفتين في أن واحد .الأولى متمثلة في البحث عن الأدلة المتعلقة بالإثبات أو النفي فهو يلعب دور المحقق حين يتفحص الأدلة ثانيا يلعب دور الحكم الذي يبحث عن الحقيقة . وعليه فإجراءات التحقيق إجراءات التحقيق معقدة لتناوبها في ذات الوقت بين الإجراءات والحكم Résumé: L'enquête sur le système de juge de droit algérien est une autorité judiciaire investie dans les vastes pouvoirs de l'Assemblée législative à des procédures d'enquête primaires sous qui considère le degré de dépenser l'enquête qu'ils jouent la raffinerie, qui ne passe pas par le rôle, mais mis en place pour séparer les questions. législateur algérien a confié la tâche de l'enquête préliminaire au juge d'instruction après leur première en matière pénale.
