Abstract

الملخص بالغة العربية: يعتبر كل من نظام الصلح والوساطة من الأنظمة الجديدة التي أفرزتها السياسة الجنائية المعاصرة وذلك لمساهمة كل من النظامين في العلاج الزيادة الهائلة والمستمرة في عدد القضايا التي تنظرها المحاكم الجنائية ولا يقتصر دورها على هذا فحسب بل تم اتخاذها لحل النزاع بالوسائل الحديثة بدل من الوسائل التقليدية، كما أنها الأداة المفضلة لتنمية روح الرضا والتسامح بين الجاني والمجني عليه، أي ما يسمى بالعدالة الشرعية. Résumé : Le systéme de conciliation et le médiation c’est un nouvel systéme utilisé par le messeur pénal du l’état pour un obgective du develope les afier du civil pénal paéque le objective principal du l’état une feun du litige par exemple ou sujet de ne paumou la ponsition alimontation et les auier de conflit entre le persone et contravenstion la conciliation ploquer la pénal.Abstract : Each of the Magistrates system and mediation of the new systems created by contemporary criminal policy is because the contribution of each of the two systems in the treatment enormous and continuous increase in the number of cases heard by the criminal courts, which is not its role is limited to this, but have been taken to resolve the dispute with modern facilities rather than traditional means, as it is the tool of choice for the development of the spirit of complacency and tolerance between the offender and the victim, the so-called justice legitimacy.
