Abstract

الملخص: لقد شهد العالم قفزة هائلة في مجال الطب وبكافة الوسائل المستحدثة إذ تجاوز بذلك الحدود المتعارف عليها في مجال الأعمال الطبية التقليدية ومن بين هذه الإنجازات عمليات نقل وزرع الأعضاء البشرية هذا الإنجاز الذي بعث في المجتمع املا كبيرا بإنقاذ حياة الكثيرين من المرضى بالعلاج الذي يعد الهدف الاسمى لهذه المهنة .غير أن هذه العمليات لازالت تثير إشكالا وتخوفا كبيرا لما قد يترتب عنها وفقهاء الشريعة الى البحث عن مدى مشروعية التصرف في الجسم الناجم عن هذه الاعمال والاساس القانوني لإباحتها ,موقف المواثيق والاتفاقيات من اعتبار بعض الممارسات التي تشكل انتهاكا للجسم البشري وتعتبرها محضورة عليه : Résumé De nos jours, le monde a connu un bond énorme dans le domaine de la médecine notamment dans les techniques et les méthodes jusque-là reconnues dans les travaux médicaux traditionnels.
