دور القاضي في إكمال نطاق العقد

Abstract

الملخص باللغة العربية: يكتسي موضوع تكملة العقد أهمية كبيرة كونه يضمن سد النقص الذي يعتري العقد وتنفيذه بما يحقق الغاية التي قصدها المتعاقدان من وراء تعاقدهم، فإذا حدد الأطراف المسائل الجوهرية في العقد وأغفلوا المسائل التفصيلية فيه ولم يعلقوا انعقاد العقد عليها نشأ هذا الأخير صحيحا، ومن خلال نظام تكملة العقد الذي أقره المشرع يتولى القاضي تحديد المسائل التفصيلية في العقد مستندا في ذلك إلى طبيعة الالتزام القانون، العرف والعدالة.

Résumé : Le sujet de l’achèvement du contrat se couvre d’une grande importance car il comble l’imperfection qui afflige le contrat. Si les parties déterminément les points essentiels du contracte y négligent les points détail sans stipuler que la faute d’un tel accord serait sans effet e ce contrat est réputé conclu, et à travers le système juridique de l’achèvement du contrat décidé par législateur le juge prendra en charge la détermination des points de détail négligés dans le contrat, en se basant sur la nature de l’obligation, de la loi, de l’usage et de la justice.

Abstract : The theme of tme achevement of the contract has covred a great importance, because of its role to complete the desavntage of the performance of the contrat, the caractars want to achieve which their goels according ro this contrat. If tha parts of the contrat determine the essentiel points and ignore details, the contrat will be acheived saccessfuly. According to the acheivement of the contrat, the judge takes onro conssideration in detremination of detaiks in contrat and based on the nature of obligation, law, custom and justice.
