جريمة التهريب

Abstract

يعتبر التهريب من الجرائم الاقتصادية بشكل خاص،و التي من شانها التأثير سلبا على اقتصادالدول ونموها وعلى أمنها العام مهما كانت مكانتها متطورة أو في طريق النمو ،كما تعمل على إفشال السياسة الرامية إلى حماية المنتجات المحلية ، وخلق اضطرابات داخلية ، أين عرفت تطورا رهيبا في الفترة الأخيرة ،جراء الدينامكية غير المسبوقة لحركة البضائع أ ومام ، خلق التكتلات الاقتصادية لعديد من الدول ،ومن جهة أخرى لما تديره من أرباح مالية على الضالعين و المساهمين في هذه الجريمة . تماشيا مع ما تم ذكره ، وجب علينا معرفة الأسباب و العوامل التي ساهمت في تطور ظاهرة التهريب في الجزائر ، ولمحاربتها و التصدي لها انتهجت الدولة إستراتجية منظمة ، بالاعتماد على الإطار المؤسساتي متمثل في مصالح الجمارك ، التي تعتبر المؤسسة الأولى المنوط بها مكافحتها،معززة بالديوان الوطني و اللجان المحلية لمكافحة التهريب ، علاوة على المصالح الأمنية الأخرى كالأمن و الدرك الوطني، في إطار قيامهم بمهامهم المعتادة ، و هذا الإطار المؤسساتي تم دعمه بإطار تشريعي أهمه ، قانون الجمارك و قانون مكافحة التهريب ، معزز بقوانين المالية السنوية.

Summary Smuggling is considered one of the economic crimes in particular, which is concerned with a negative impact on the economy of countries and on their public security, regardless of their developed status or in the path of growth, and works to thwart the policy aimed at protecting local products and creating internal disturbances, where it has known a terrible development In the recent period, due to the unprecedented dynamism of the movement of goods and in front of the creation of economic blocs in many countries, and on the other hand, due to the financial profits they manage to those involved and contributors to this crime. In line with what has been mentioned, we have to know the essentials and factors that contributed to the development of the phenomenon of smuggling in Algeria. The national and local committees to combat smuggling, in addition to other security interests such as security and the national gendarmerie, within the framework of their usual accusations or this institutional framework was supported by a legislative framework, said Red and the Anti-Smuggling Law, reinforced by annual financial laws .
