Abstract: The stage of the judicial investigation is one of the most important stages in the public case, and the military law has paid great attention to it in terms of the correct application of the law in a way that guarantees the accused to guarantee his rights. From this point of view, the legislator set strict procedural rules that may not be violated or abandoned, nor violated their requirements, and set up a penalty for this that was termed null and void. Therefore, invalidity is the penalty incurred by the procedure as a result of its violation or omission of a fundamental rule, and as a result of which it does not produce any legal effect. Accordingly, since the military judiciary has a special nature in the procedures followed before it, the issue of the invalidity of the procedures in the stage of the judicial investigation is a topic that deserves to be concerned and to be studied and to be informed of everything related to it and its effects
