Abstract

ملخص: إن عقد الوكالة التجارية هو عقد يقوم بمقتضاه الوكيل بإنابة الموكل للقيام بأعمال تجارية باسم ولحساب موكله قصد إتمام جميع نشاطاته التجارية المتعددة وذلك لكثرة معاملاته و نشاطاته التجارية، وينشأ و ينقضي هذا العقد شأنه شأن جميع العقود الأخرى، كما يرتب هذا العقد التزامات في ذمة طرفيه ويقابلها ضمانات تحمي لهم حقوقهم ، ويساهم عقد الوكالة التجارية إلى حد كبير في ازدهار وتطور النمو الاقتصادي على المستوى الداخلي و الخارجي. Résumé Le mandat commercial est un acte par lequel le mandant délègue au mandataire, le soin d'entreprendre des activités commerciales, au nom et pour le compte de son mandant, à l'effet d'accomplir toutes tâches commerciales, du fait de la multiplicité des transactions et des activités commerciales. Ce type d'acte naît et expire comme tous les autres actes. Il engendre des obligations à la charge des deux parties en contre partie des garanties protégeant leurs droits. Le mandat commercial favorise largement l'épanouissement et le développement économique soit sur le plan local ou international. Abstract: The commercial power of attorney is a document by which, a principal gives a proxy, a power to carry out commercial activities, in the name and for the account of his principal, in order to accomplish various commercial tasks due to multiplication of commercial transactions. Such deed arises and expires as all other deeds. It generates obligations for both parties, in consideration of the guaranties protecting their rights. Commercial power of attorney largely contributes, to economic development, both nationally and internationally.
