Abstract

ملخص الدراسة: تعتبــــــــر جريمــــــــة الاتجار بالبشــــــــر من الجرائم ذات الصدى العالمي بعد جريمتي المخدرات والسلاح، باعتبار أن تناميها أخذ بعدا جغرافيا واسع النطاق مما ترتب عليه انعكاسات سلبية على المجتمع بصفة عامة وعلى فئة خاصة من البشر. وهذا لظروف فقرهم الشديد وعدم توفر فرص العمل والاختلافات الإقليمية والتفاوت الاقتصادي وعدم الاستقرار السياسي والنزاع المسلح، وهذا ما جعلهم فريسة سهلة للمتاجرين للإيقاع بهم، وذلك من خلال بعض المغريات واستخدام أساليب قسرية، ونظرا لخطورة هذه الظاهرة فإن المجتمع الدولي بذل جهود معتبرة لمكافحة هذه الجريمة، من خلال الاتفاقيات المناهضة لهذه الجريمة على غرار برتوكول باليرمو لسنة 2000م، الذي حاول وضع تعريف عالمي لجريمة الاتجار وحدد أهم الأفعال التي تدخل ضمن الركن المادي وليس هذا فقط، بل وجدت جهود أخرى على المستوى الإقليمي، والتي جسدها المشرع الجزائري من خلال المصادقة على جملة من الاتفاقيات وتكريسها في منظومته العقابية.Résumé de l'étude Le crime de trafic des êtres humains est un crime du monde entier après le crime de drogue et d’armes, que sa croissance a pris une dimension géographique large, avec des répercussions négatives sur la société en général et sur une catégorie spéciale d’êtres humains. C’est à cause de leur extrême pauvreté, le manque de possibilités d’emploi, les différences régionales, les disparités économiques, instabilité politique et les conflits armés, et c’est ce qui les rendait une proie facile pour les trafiquants à leur place, par le biais de certains incitatifs et en utilisant leurs méthodes mansion et compte tenu de la gravité de ce phénomène, la communauté internationale a déployé des efforts considérables pour lutter contre ce crime à travers les conventions contre ce crime, s’inspirant de la Palerme protocole 2000, qui a tenté d’établir une définition globale du crime de trafic et identifié les actes les plus importants au sein du pilier physique, non seulement cela, mais les efforts Au niveau régional, qui a été incorporé dans le législateur algérien par le biais de la ratification et la consolidation d’un certain nombre de conventions dans son système pénal.Summary of the study The crime of trafficking in human beings is a world-wide crime after the crime of drugs and arms, as its growth has taken a broad geographical dimension, with negative repercussions on society in general and on a special category of human beings. This is because of their extreme poverty, lack of employment opportunities, regional differences, economic disparity, political instability and armed conflict, and that's what made them easy prey for the traffickers to set them up, through some inducements and using their mansion methods, and given the seriousness of this phenomenon, the international community has made considerable efforts to combat this crime through the conventions against this crime, modeled on the Palermo Protocol 2000, which attempted to establish a global definition of the crime of trafficking and identified the most important acts within the physical pillar, not only that, but the efforts At the regional level, which was embodied in the Algerian legislature through the ratification and consolidation of a number of conventions in its penal system.
