الالتزام التضاممي

Abstract

الملخص تطرقت مذكرتنا أحد الأوصاف التي ترد على أطراف الالتزام عند تعددهم وهو ما يعرف بالالتزام التضاممي الذي يرمي إلى تأمين الوفاء بالالتزام وتيسيره على الدائن في حالة تعدد المدينين بدين واحد متعدد المصادر،حيث تناولت الدراسة موضوع التضامم من خلال التطرق إلى وجود الالتزام التضاممي ونشأته، ومنها عرجنا إلى شروط قيام الالتزام التضاممي ، وأساسه القانوني الذي يتأرجح بين النظرية التقليدية والنظرية الحديثة في تأسيسه، ومن ثم تم استعراض أثار القانونية المترتبة عن التضامم بين الأطراف أولا في العلاقة بين دائن والمدين ممثلة في مجموعة من المبادئ التي تحكمها وثانيا أثار العلاقة بين المدينين المتضاممين فيما بينهم وبعد ذلك إلى نطاق تطبيق الالتزام التضاممي فوجدنا أن الالتزام التضاممي مطبق بصفة غير مباشرة في التشريع ( في نطاق الكفالة، ودعوى مباشرة ، عقد التأمين، الإنابة الناقصة ) ويطبق كذلك في القضاء (في حالة المسؤولية تقصيرية وفي حالة اجتماع الالتزام عقدي مع الالتزام تقصيري، تعدد الأخطاء مع اختلاف مصدرها ، المسؤولية العقدية عن عمل الغير).

Abstract : for the creditor in the case of multiple debtors with one debt of a multi-source . The conditions for the establishment of the joint obligation , and its legal basis which fluctuates between the traditional Theory and the modern theory in its establishment , and then the legal effects of the solidarity between the parties were reviewed first in the Relationship between the creditor and the debtor represented in a set of principles That govern It and secondly the effects of the Relationship between the joint debtors among then , and then to the scope of the application of the joint obligation, and we fond That the joint obligation is indirectly applied in legislation ( within the scope of surety, direct action ,insurance contract , incomplete representation )and It is also applied in the judiciary ( in the case of tort liability , and in the case of a contractuel obligation combined with a tort obligation ,multiple errors with différent source ,contractual liability for the work of others).

Résumé en français : Notre note a abordè l’une des qualificatifs qui sont donnès aux parties à l’obligation lorsqu’elles sont multibles ,c’est ce qu’on appelle l’obligation solidaire ,qui vise à sécuriser et àfaciliter l’exècution de l’obligation pour le crèancier en cas de dèbiteursmultibles avec une dette d’une source multiple lesconditions de constitution de l’obligation solidaire ,et son fondement juridique ,qui oscille entre la thèorie traditionnelle et la thèorie moderne dans sa constitution ,puis les effets juridiques de lasolidaritè entre les parties ont été examinèes d’une part dans la relation le crèancier et le dèbiteurreprèsentèe dans une ensemble de principes qui la règissent et d’autre part les effets de la relation entre les co-dèbiteurs entre eux ,et pris champ d’application de l’obligation solidaire ,et nous avons constatè que l’obligation solidaire s’applique indirectement dans la lègislation ( dans le cadre du cautionnement ,de l’action directe ,du contrat d’assurance ,de la repèsentation incomplète ) et qu’elle s’applique ègalement dans le domaine judiciaire ( en cas de responsabilitèdèlictuelle ,et en cas d’obligation contractuelle combinèe à une obligation dèlictuelle , fautes multibles de source diffèrente , responsabilitè contractuelle du fait d’autrui )
