Abstract

الملخص: يعتبر عقد التسيير لمؤسسة عمومية اقتصادية طريقة حديثة لتسييرها و هذا نظرا لمتطلبات المؤسسة العمومية الاقتصادية التي لم تستطع وسائل التسيير التقليدية تلبيتها ، و يعرف عقد التسيير بأنه : اتفاق بين مؤسسة و مسير يتمتع بشهرة معترف بها في النشاط الذي تعمل فيه المؤسسة ، يقوم المسير بمختلف الأعمال على أملاك المؤسسة ، كل ذلك يستدعي الحرص في اختياره ، و ترك المشرع الحرية للمؤسسة العمومية الاقتصادية في طريقة اختيار المسير و في الغالب تكون بإحدى الطريقتين ، الاولى الدعوة الى المنافسة الثانية التفاوض المباشر او التراضي، و يترتب على هذا العقد التزامات يتحملها طرفي عقد التسيير ( المؤسسة العمومية الاقتصادية ، المسير ) بموجب عقد التسيير و بحسن نية. Résumé en français : Le contrat de management d’une entreprise publique économique est une technique de gestion moderne, en raison des exigences de l’entreprise publique économique que les moyens d’administration traditionnels ne pouvaient pas satisfaire ,le contrat de gestion est défini comme : un accord entre une entreprise et un gestionnaire bien connu dans l’activité dans laquelle l’entreprise opère,le gestionnaire accomplit diverses actions sur la propriété de l’entreprise, qui toutes appellent du soin dans son choix, et le législateur laisse la liberté de l'institution publique économique dans le mode de choix de Le gestionnaire, et dans la plupart des cas c'est dans l'une des les deux méthodes, la première étant le La promotion de la concurrence , second est la négociation directe ou le consensuel,ce contrat comporte des obligations contractées par les parties au contrat de management (entreprise économique publique, Le gestionnaire) dans le cadre Le contrat de management et de bonne intention Abstract in English : The management contract of an economic public enterprise is a modern management technique, due to the demands of the economic public enterprise that the traditional means of administration could not satisfy, the management contract is defined as: an agreement between an enterprise and a manager well known in the activity in which the enterprise operates, the manager carries out various actions on the property of the enterprise, all of which call for care in his choice, and the legislator leaves the freedom of the economic public enterprise in the mode of choice of the manager, and in most cases it is in one of the two methods , the first being the promotion of competition, the second is direct negotiation or consensual, this contract entails obligations contracted by the parties to the management contract (public economic enterprise, the manager) within the framework of the management contract and in good intention.
