الملخص باللغة العربية: يحظى موضوع حماية المكتتب في الترقية العقارية باهتمام متزايد اليوم من طرف الباحثين القانونيين لذلك يقتضي البحث في هذا الموضوع الإلمام بمختلف الجوانب القانونية والتنظيمية التي تحيط بها، بما في ذلك الإطار القانوني المنظم له، بالإضافة على الآثار القانونية المتحكمة فيه، وهذا بهدف توفير الحماية الكافية التي تبعث الاطمئنان في نفس المكتتب وتسهم في جذب المزيد من المكتتبين نحو المؤسسات الترقوية وهذا بهدف القضاء على أزمة السكن، ومن أجل مسايرة التطويرات الحاصلة في هذا المجال.

Résumé : Le sujet de la protection du souscripteur dans la promotion immobilière fait l'objet d'une attention croissante aujourd'hui de la part des chercheurs en droit, ainsi la recherche sur ce sujet nécessite une connaissance des différents aspects juridiques et réglementaires qui l'entourent, y compris le cadre juridique qui le réglemente, en plus des effets juridiques qui la contrôlent, et ce dans le but d'assurer une protection adéquate qui rassure l’esprit du souscripteur et contribue à attirer plus de prétendants à la souscription vers les établissements de promotion, dans le but d'enrayer la crise du logement, et afin de suivre le rythme de les évolutions en cours dans ce domaine.
