المسؤولية الجزائية الناجمة عن سوء إدارة النفايات الطبية

Abstract

ملخـــــــــص إن الهدف الذي تصبو إليه مذكرة تخرجنا هذه هو تحديد المسؤولية الجزائية عن سوء إدارة النفايات الطبية وكذا إظهار العلاقة الموجودة بين النصوص القانونية لتنظيم وتسيير إدارة النفايات، ومن ثم تطرقنا الى الطرق القانونية للتخلص من هذه النفايات الطبية وما مدى مخاطرها على البيئة والإنسان سواء. توصلنا الى أن الحد من مخاطر هذه المخلفات يكون بجهود كل من الجهات المعنية والمسؤولين المعنيين وتبرز هذه الدراسة كذلك موقف المشرع الجزائري لمشكلة النفايات الطبية وما يتعلق بها من تسيير وادارة وما يترتب عن مسؤولية جزائية جراء التسيير الغير الصحيح أو الخاطئ وللإجابة على كل هذه التساؤلات طرحنا الإشكالية التالية: ماهي الآليات القانونية للتخلص من النفايات الطبية وكيف تثار المسؤولية الجزائية عن فعل هذه النفايات

Résumé : L'objectif de cette note de fin d'études est de déterminer la responsabilité pénale pour la mauvaisegestion des déchets médicaux, ainsi que de montrer la relation qui existe entre les textes juridiques pour la réglementation et la gestion de la gestion des déchets, puis nous avons abordé les voies juridiques pour éliminer ces déchets médicaux et l'étendue des risques qu'ils présentent pour l'environnement et pour l'homme. Nous avons conclu que la réduction des risques de ces déchets passe par les efforts à la fois des autorités concernées et des fonctionnaires concernés.Cette étude met également en évidence la position du législateur algérien sur le problème des déchets médicaux et la gestion et la gestion qui y sont liées et les conséquences responsabilité pénale du fait d'une gestion incorrecte ou erronée. Pour répondre à toutes ces questions, nous avons posé le problème suivant : Quels sont les mécanismes juridiques pour l'élimination des déchets médicaux, et comment la responsabilité pénale est-elle engagée pour faire ces déchets ?

Abstract: : The objective of this endnote is to determine the criminal responsibility for the management of medical waste, as well as to show the relationship that exists between the legal texts for the regulation and management of waste management, then we discussed the legal avenues for disposing of this medical waste and the extent of the risks it poses to the environment and to humans. We have concluded that reducing the risks of these wastes requires the efforts of both the authorities concerned and the officials concerned. This study also highlights the position of the Algerian legislator on the problem of medical waste and the management and management related to it and the consequences of criminal liability due to incorrect or erroneous management. To answer all these questions, we have posed the following problem: What are the legal mechanisms for the disposal of medical waste, and how is criminal liability incurred for doing this waste?
