جودة الصياغة التشريعية ودورها في تحقيق الأمن القانوني

Abstract

- الملخـــــــــص: الجودة التشريعية هي غاية تطمح لها النظم المعاصرة، لما لها من آثار ايجابية على المنظومة القانونية ككل. إلا أن تحقيقها مرتبط بصياغة نصوص تشريعية جيدة سواء من الناحية الشكلية أو الموضوعية، لذلك بقدر ما تكون الصياغة التشريعية ذات جودة بقدر ضمان الحق في الوصول للقانون وتحقيق الأمن القانوني، والتطور، كما تتفق معظم الدول على وجود نظام رقابة فعال يمكّنها من مراقبة هذه الجودة، وهو ما يطلق عليه بالرقابة على جودة التشريعات، بغية الوصول إلى الاستقرار والأمن في المجتمع. .

Résumé : La qualité législative est une finalité des régimes contemporains, car elle a un impact positif sur l’ensemble du régime juridique. Cependant, sa réalisation est liée à la rédaction de bons textes législatifs, tant formellement qu’objectivement. dans la mesure où la rédaction législative est de qualité que ça va garantir le droit d’accès à la loi , la sécurité juridique, et le développement. la plupart des États conviennent de disposer un système de contrôle efficace pour contrôler la dite qualité, Il s’agit de contrôler la qualité de la législation en vue d’assurer la stabilité et la sécurité de la société

Summary. : Legislative quality is a goal of contemporary regimes, as it has a positive impact on the entire legal system. However, its achievement is linked to the drafting of good legislation, both formally and objectively. To the extent that legislative drafting is of good quality it will guarantee the right of access to the law, legal certainty, and development. most states agree to have an effective control system to monitor the said quality. this is to control the quality of legislation with a view to ensuring the stability and security of society.
