حق المجني عليه في إنهاء الدعوى العمومية في التشريع الجزائري

Abstract

الملخص : يتمحور موضوع دراستنا حول حق المجني عليه في انهاء الدعوى العمومية , إذ توصلنا إلى أن المشرع الجزائري اعطى الحق للمجني عليه في انهاء الدعوى العمومية بارادته المنفردة عن طريق التنازل عن الشكوى في الجرائم التي قيد تحريكها من طرف النيابة بشكوى , والتي حددها على سبيل الحصر في نصوصه القانونية . كما نجده منحه الحق ايضا في انهاء الدعوى بالاتفاق مع المتهم , كطرف اساسي لنظامي الصلح والوساطة مع التوصل إلى الاثار القانونية المترتبة عليهما.

Sommaire : Le sujet de notre étude tourne autour du droit de la victime de mettre fin au procès public, car nous avons conclu que le législateur algérien a donné le droit à la victime de mettre fin unilatéralement au procès public en renonçant à la plainte dans les crimes qui ont été intentés par la poursuite avec plainte, ce qu'il précise exclusivement dans ses textes Juridiques. Nous le trouvons également lui donnant le droit également de mettre fin à l'affaire en accord avec l'accusé, en tant que partie principale aux systèmes de conciliation et de médiation avec la réalisation des conséquences juridiques qui en découlent.

Summary:

The subject of our study revolves around the right of the victim to end the public trial, because we concluded that the Algerian legislator gave the right to the victim to unilaterally end the public trial by renouncing the complaint in crimes that were brought by the lawsuit with complaint, which he specifies exclusively in his legal texts. We also find it giving him the right also to end the case in agreement with the accused, as the main party to the systems of conciliation and mediation with the realization of the legal consequences deriving therefrom.
