Abstract

الملخص : إن دراسة موضوع دفاتر الشروط في عقود الصفقات العمومية، أوصلنا إلى التأكد من الإرتباط الوثيق لدفتر الشروط بعقود الإدارة، ذلك لتأثيره المهم في النظام القانوني الذي يحكم الصفقات العمومية، حيث لا يمكن إبرام الصفقة العمومية إلا بوضع دفتر الشروط، الأمر الذي يجعله منظما للعلاقة القانونية بين المصلحة المتعاقدة والمتعامل المتعاقد، فهو الوثيقة التي تحدد شروط التعاقد بينهما، واحترام هذه الشروط يؤدي إلى تحقيق مبدأ شفافية الإجراءات والمساواة والمنافسة النزيهة وذلك للنهوض بالمرفق العام.

Résumé: L'étude de la question des cahier des charges dans les marchés publics, nous a conduit à constater le lien étroit du cahier des charges avec les contrats de gestion, en raison de son impact important sur le régime juridique qui régit les marchés publics, ou le marché public ne peut ètre conclu que en plaçant le cahier des charges, ce qui en fait un organisateur de la relation juridique entre l'intérèt contractant et le concessionnaire contractant, c'est le document qui définit les termes du contrat entre eux, et le respect de ces conditions conduit à atteindre le principe de transparence des procédures, de l'égalité, de la concurrence et de l'éducation pour faire progresser la fonction

Summary: The study of the subject of condition books in public deals contacts, led us to ascertain the close link between the terms book and management contracts, due to its important impact on the legal system that governs public deals, where the public deal can only be concluded by placing the terms book, which makes it an organizer of the legal relationship between the contracting authority and the contracting dealer, it is the document that defines the terms of the contact between them, and respect for these conditions leads to achieving the principle of transparency of procedures, equality and fair competition in order to advance in the public utility.
