طرق الطعن العادية في المادة الجزائية

Abstract

ملخص تعد طرق الطعن في الاحكام الجزائية وسائل رسمها القانون للاعتراض على حكم صادر من المحكمة وطلب عرضه مرة أخرى على القضاء قبل ان يصبح نهائيا واجب التنفيذ، وطرق الطعن في الاحكام اما ان تكون طرقا عادية او طرقا غير عادية، تتمثل طرق الطعن العادية في المعارضة والاستئناف، فالمعارضة تعيد الدعوى الى ذات المحكمة التي أصدرت الحكم الغيابي، اما الاستئناف فيعرض الدعوى على جهة قضائية أعلى درجة من المحكمة التي أصدرت الحكم الحضوري.

ABSTRACT The methods of appealing penal judgments are the means drawn up by the law to object to a judgment issued by the court and request that it be presented again to the judiciary before it becomes final and enforceable. The opposition returns the case to the same court that issued the judgment in absentia, while the appeal submits the case to a judicial authority higher than the court that issued the judgment in absentia.

Résumé Les voies d'appel des jugements pénaux sont les moyens prévus par la loi pour s'opposer à un jugement rendu par le tribunal et demander qu'il soit à nouveau présenté à la justice avant qu'il ne devienne définitif et exécutoire. L'opposition renvoie l'affaire au même tribunal qui a rendu le jugement par défaut, tandis que l'appel soumet l'affaire à une juridiction supérieure à la juridiction qui a rendu le jugement par défaut.
