الحماية المؤسساتية للملكية الفكرية في الجزائر

Abstract

ملخص الدراسة : أصبحت الحاجة إلى حماية حقوق الملكية الفكرية في النظام القانونية المعاصرة أمرا حتميا نظرا لأهميتها ، هذا ما جعل المشرع الجزائري و على غرار التشريعات المقارنة يقوم بإقرار أحكام قانونية تحدد و تنظم كيفية حماية هذه الحقوق و على هذا الأساس اعتمدت هيئات إدارية مختصة كالديوان الوطني لحقوق المؤلف و الحقوق المجاورة و المعهد الوطني الجزائري للملكية الصناعية ، بالإضافة إلى هيئات إدارية غير متخصصة من بينها إدارة الجمارك و إدارة التجارة ، كآليات تقوم بمهام الحماية الإدارية لحقوق الملكية الفكرية التي تعد من أبرز أنواع الحماية وذلك بإعتبارها القاعدة أو الأساس التي تستند إليه الحماية المدنية و الجزائية .

Résumé : La nécessité de protéger les droits de propriété intellectuelle dans les systèmes juridiques contemporains sont devenus inévitables en raison de son importance, voilà ce que fait le législateur algérien et de la législation comparative similaire l'adoption de dispositions juridiques qui définissent et régissent la façon de protéger ces droits, et sur cette base il adopte les organes administratifs spécialisés comme l'office nationale des droit d'auteur et des droits voisins (ONDA) et Institut national algérien de la propriété industrielle (INAPI), en plus des organes d'administration algérienne est non spécialisée, y compris le Département des douanes et de l'administration du commerce, en tant que mécanismes sont les fonctions de protection administrative des droits de propriété intellectuelle, qui est l'un des plus importants types de protection, En tant que base pour la protection civile et pénale.

abstract : In the need of protect intellectual property rights in the contemporary legal system has become an inevitably ;due to its importance ;this is what made the Algerian legislator; in the manner of comparative legislation; Adopt legal provisions that define and regulate how to protect these rights.on this basis;specialized administrative bodies such as the national office of copyrights and related rights and the Algerian national institute fot industrial property have been appoved ;in addition to non-specialized administrative bodies .Among them are the customs administration and the trade administration as mechanisms that carry out the tasks of administrative protection og intellectual property rights,which is one of the most prominent types of protection; as it is the basis or base on which civil and penal protection is based
