أنظمة تكييف العقوبة وآليات تجسيدها في التشريع الجزائري

Abstract

الملخص: يعتبر تكييف العقوبة إيجاد لنظام علاجي يتلائم وشخصية المحكوم عليه، إذ باتت عملية التأهيل الهدف الأساسي للسياسة العقابية، حيث تبنى المشرع الجزائري هذه الفكرة في القانون 05−04 بإقراره لإجازة الخروج، التوقيف المؤقت لتطبيق العقوبة، الإفراج المشروط والمراقبة الالكترونية كأنظمة لتكييف العقوبة وفق شروط موضوعية وأخرى إجرائية، تتكفل بها أجهزة مختصة، ينتج عنها آثار على المحكوم عليه والمجتمع، أهمها إعادة التأهيل.

Résumé: L’adaptation de la punition est considérée comme la création d’un système de traitement adapté à la personnalité du condamné, Car le processus de réhabilitation est devenu l’objectif principal de la politique punitive, Le législateur algérien ayant adopté cette idée dans la loi 05-04 en approuvant le permis de sortie, La suspension temporaire de l’application de la punition, La libération conditionnelle et la surveillance électronique en tant que systèmes qui adaptent la punition en fonction de conditions, Des objectives et des procédurales, Parrainés par des institutions spécialisées, Entraînant des effets sur le condamné et la société, Dont le plus important est la réinsertion.

Abstract : The adaptation of punishment is considered as a treatment system that was created to suit the personality of the convict, The rehabilitation process has become the main goal of the punitive policy, The Algerian legislator adopted this procedure by the law 05−04 that approves the exit permit, The temporary suspension of the application of the penalty, The conditional release and the electronic monitoring as systems in order to adapt the punishment according to the objective and the procedural conditions, Sponsored by specialized organismes, resulting in many effects on the convict and the society, The most important of which is the rehabilitation .
