آليــــــات إدمـــــاج المحبوسيــــن والأطفــــــال المسعفيــــن في التشريع الجزائري

Abstract

ملخص: أولى المشرع الجزائري عناية خاصة بكل من فئة المحبوسين والأطفال المسعفين، كونهما من الفئات الضعيفة والمحرومة التي تحتاج إلى دعم ورعاية خاصة، فبالنسبة للمحبوسين سخر هيئات تضمن التكفل الأمثل بالمحبوسين أثناء التنفيذ العقابي وتمتد إلى ما بعد الافراج والمتمثلة في: قاضي تطبيق العقوبات، لجنة تطبيق العقوبات، لجنة تكييف العقوبات، اللجنة الوزارية المشتركة، المصالح الخارجية لإدارة السجون، وكذا منظمات المجتمع المدني. كما خص المشرع فئة الأطفال المسعفين بأحكام قانونية خاصة ترتكز على تطبيق تدابير ملائمة لها بهدف اصلاحهم وإعادة ادماجهم في الأسرة والمجتمع وتوفير الحماية والسند لهم فبعودتهم إلى المجتمع والمشاركة في العمل والحياة الاجتماعية، فإنهم يساهمون في تعزيز النمو الاقتصادي وتقوية قدرات المجتمع بشكل عام.

Abstract: The Algerian legislator gives special attention to both detainees and paramedic children, as they are vulnerable and deprived groups in need of specific support and care. For detainees, various bodies are dedicated to ensuring optimal care throughout the execution of their sentences and extending to post-release. These bodies include the sentencing judge, the parole board, the adaptation of sentences committee, the joint ministerial committee, the external services of the prison administration, and civil society organizations. Moreover, the legislator has also provided specific legal provisions for paramedic children, focusing on the implementation of appropriate measures aimed at their rehabilitation and reintegration into families and society, while ensuring their protection and support. By reintegrating into society and participating in work and social life, these children contribute to promoting economic growth and strengthening the capacities of the community as a whole

Résumé: Le législateur algérien accorde une attention particulière aux catégories des détenus et des enfants paramédicaux, car ils font partie des groupes vulnérables et défavorisés qui ont besoin d'un soutien et de soins spéciaux. Pour les détenus, des organismes sont mis en place pour assurer une prise en charge optimale des détenus pendant l'exécution de la peine et au-delà, notamment : le juge de l'application des peines, la commission d'application des peines, la commission d'adaptation des peines, la commission ministérielle mixte, les services extérieurs de l'administration pénitentiaire, ainsi que les organisations de la société civile. Le législateur accorde également une attention particulière aux enfants paramédicaux en leur accordant des dispositions juridiques spéciales qui reposent sur la mise en œuvre de mesures appropriées dans le but de les réhabiliter et de les réintégrer dans la famille et la société, et de leur fournir protection et soutien. En revenant à la société et en participant au travail et à la vie sociale, ils contribuent à renforcer la croissance économique et les capacités de la société en général
