تسوية المنازعات الرياضية عن طريق التحكيم الرياضي الدولي

Abstract

الملخص: تسند مهمة الفصل في النزاعات الرياضية لمحكمة التحكيم الرياضية TAS وذلك عن طريق التحكيم او الوساطة وقد تم إنشاء مجلس التحكيم الرياضي الدولي مهمته الإشراف المالي والإداري، ودعم استقلاليتها وتشكيل محكمي محكمةTAS وقد وضعت المحكمة قواعد قانونية وأنشأت قسمي تحكيم من أجل التمييز بين فئتين من المنازعات وفقا لنوع إجراءات التحكيم الرياضية التي يخضع لها كل قسم لضمان حسن سير الإجراءات، إضافة الى ذلك فإن القرارات الصادة عن هذه المحكمة تعد إلزامية ونهائية وغير قابلة للطعن.

Résumé: La mission de trancher les litiges sportifs est confiée au Tribunal Arbitral du SportTAS, par voie d'arbitrage ou de médiation. Le Conseil International d'Arbitrage Sportif a été créé avec pour mission de supervision financière et administrative, de soutien à son indépendance et à la formation des arbitres des tribunaux du TAS. Le tribunal a élaboré des règles juridiques et créé deux sections d'arbitrage afin de distinguer entre deux catégories de litiges selon le type de procédures d'arbitrage sportif auxquelles chaque section est soumise pour assurer le bon déroulement des procédures, outre cela, les décisions rendues par cette juridiction sont impératives, définitives et non susceptibles d'appel.

Summary: The task of adjudicating sports disputes is entrusted to the Court of Arbitration for SportTAS, through arbitration or mediation. The International Sports Arbitration Council was established with its mission of financial and administrative supervision, support for its independence and the formation of TAS court arbitrators. The court has developed legal rules and established two arbitration sections in order to distinguish between two categories of disputes according to the type of sports arbitration procedures that each section is subject to to ensure Proper conduct of procedures, in addition to that, the decisions issued by this court are mandatory, final and not subject to appeal.
