تجميد عقوبة الإعدام بين القانون الجزائري و الشريعة الإسلامية

Abstract

ملخص البحث: من خلال عملية البحث توصلنا إلى أن عقوبة الإعدام تطبق على الجرائم الخطيرة التي تمس بأمن الدولة و إستقرارها، في كل من القانون الجزائري و الشريعة الإسلامية، إلا أن هناك حالات خاصة يوقف فيها تنفيذ هاته العقوبة و حالات أخرى تسقط فيها في كل منهما. إلا أن عقوبة الإعدام جمدت في كل من القانون الجزائري و الشريعة الإسلامية، عندما مر كل واحد منهما بظروف معينة أجبرته على تجميد هاته العقوبة لزمن ما.

Rèsumè: Dans cette recherche , le pien de mort est appliquèe aux crimes graves qui portent attention à la sècuritè de l’ètat aussi bien en droit algerien qu’endroit islamique ,mais il eexiste des cas ou l’application de cette pien est suspendue et des cas ou elle est dèchue. Cependent , le pien de mort a ètè gelèè dans toutes les lois et la charia lorsque chacun d’eux a traversè certaiens criconstances qui l’ont obligè à geler cette pendant un certain temps.

Abstract: In this recherché , the death penalty is applied to serious crimes that affect the state in both aljerian law and Islamic law , but there are cases in which the implementation of this penalty is suspendend and cases in which it is forfeited. However , the death penalty was frozen in both law and sharia when each of them passed though certain circumstances that forced him to freeze this penlty for a certain period of time
