Abstract

لقد أدت الثورة الكبيرة التي يشهدها العالم حديثا في مجال تكنولوجيا المعلومات والاتصالات إلى بروز نوع جديد من العقود تقوم على أساس سرعة تبادل المعلومات يطلق عليها عقود الخدمات الإلكترونية ، فظهور هذا النوع الجديد من العقود التي تتم بشكل إلكتروني استوجب معه إيجاد إطار قانوني ينظم المعاملات التي تتم من خلاله ، لذلك فقد تطرقنا في هذه الدراسة إلى الخصوصية التي يثيرها عقد الخدمات الإلكترونية من حيث إبرامه وتنفيذه وكيفية إثباته والالتزاماتوالجزاءات المترتبة عل اطرافه ،وذلك من خلال ما جاءت به النصوص القانونية للمشرع الجزائري ، مركزين على ما جاء به القانون رقم 18- 05 المتعلق بالتجارة الإلكترونية ، والذي كان الهدف الأساسي من وضعه هو التوجه نحو اعتماد تكنولوجيا المعلومات في المعاملات التجارية والخدماتية.

Summary: The great revolution that the world is witnessing recently in the field of information and communication technology has led to the emergence of a new type of contract based on the speed of information exchange called electronic service contracts. Therefore, in this study, we have touched on the privacy raised by the electronic services contract in terms of its conclusion, implementation, and how to prove it, through what came in the legal texts of the Algerian legislator, focusing on what came in Law No. 18-05 related to electronic commerce, which was The main objective of its establishment is to move towards the adoption of information technology in commercial and service transactions.
