عقد التسيير ودوره في تفعيل التنمية الاقتصادية

Abstract

ملخص يعتبر عقد التسيير عقد حديث يندرج ضمن عقود الأعمال والتجارة الدولية، تناوله المشرع الجزائري ضمن احكام القانون المدني معتبرا إياه ذلك العقد الذي بموجبه يلتزم شخص ما او شركة متخصصة يدعى مسيرا بتسيير أملاك مؤسسة عمومية إقتصادية. يهدف عقد التسيير إلى تحديث وإعادة هيكلة التسيير للمؤسسات من خلال عنصر المعرفة الفنية، وهذا من أجل دفع عجلة التنمية الإقتصادية للدول التي تفتقر إلى تقنية التسيير، وتعزيز مكانتها ضمن شبكات التسيير الدولية.

Résumé Le contrat de gestion est un contrat moderne qui s’inscrit dans les contrats commerciaux internationaux. Le législateur algérien l’a traité dans les dispositions du Code civil, le considérant comme un contrat par lequel une personne ou une entreprise spécialisée appelée administrateur est tenue d’administrer la propriété d’une institution publique économique. Le contrat de gestion vise à moderniser et restructurer la gestion des institutions par le biais de la composante des connaissances techniques, afin de faire progresser le développement économique des pays dépourvus de technologie de gestion et d’améliorer leur place dans les réseaux internationaux de gestion.

Abstract The management contract is a modern contract which fits in with international commercial contracts. The Algerian legislature has dealt with it in the provisions of the Civil Code, considering it as a contract whereby a person or a specialized company called admin is obliged to administer the property of an economic public institution. The management contract aims to modernize and restructure the management of institutions through the technical knowledge component, in order to advance the economic development of countries lacking in management technology and enhance their place in international management networks.
