Abstract

تُعد خوصصة المؤسسات العمومية الاقتصادية إحدى أبرز آليات التحول الاقتصادي في الجزائر، حيث يُنظمها الأمر رقم 01-04 المؤرخ في 20 أوت 2001، الذي وضع الإطار القانوني للتنازل عن حصص الدولة في رؤوس أموال المؤسسات لصالح القطاع الخاص، كليًا أو جزئيًا. يهدف هذا التوجه إلى تحسين الأداء الاقتصادي، وتقليص العبء المالي على الدولة، وتعزيز مساهمة القطاع الخاص في النمو، مع ضمان الشفافية والتنافسية وتكافؤ الفرص من خلال آليات تشمل إعادة الهيكلة والتقييم والرقابة. وتمثل الخوصصة وفق هذا الأمر استراتيجية تحديث شاملة للمؤسسة العمومية. La privatisation des entreprises économiques publiques est l’un des mécanismes les plus marquants de la transformation économique en Algérie. Elle est réglementée par l'Ordonnance n° 01-04 du 20 août 2001, qui fixe le cadre juridique du transfert des parts de l'Etat dans le capital des entreprises au secteur privé, en tout ou partie. Cette approche vise à améliorer les performances économiques, à réduire la charge financière de l’État et à renforcer la contribution du secteur privé à la croissance, tout en garantissant la transparence, la compétitivité et l’égalité des chances grâce à des mécanismes comprenant la restructuration, l’évaluation et la surveillance. La privatisation, selon cet ordre, représente une stratégie globale de modernisation de l’institution publique, plutôt qu’un simple transfert de propriété, dans le but de l’intégrer efficacement dans l’environnement du marché tout en préservant l’intérêt public. The privatization of public economic enterprises is one of the most prominent mechanisms for economic transformation in Algeria. It is regulated by Order No. 01-04 of August 20, 2001, which established the legal framework for the transfer of state shares in the capital of enterprises to the private sector, in whole or in part. This approach aims to improve economic performance, reduce the financial burden on the state, and enhance the private sector's contribution to growth, while ensuring transparency, competitiveness, and equal opportunities through mechanisms that include restructuring, evaluation, and oversight. According to this order, privatization represents a comprehensive modernization strategy for public enterprises, rather than a mere transfer of ownership. The goal is to effectively integrate them into the market environment while preserving the public interest.
