النظام القانوني للنوادي الرياضية المحترفة في التشريع الجزائري

Abstract

لقد انتهجت الجزائر الى عدة إصلاحات في سبيل تطوير الرياضة من اجل المشاركة في مختلف تظاهرات واللقاءات القارية والعالمية ومواكبة العولمة والوصول الى مستوى النخبة فترتبت عن هده الإصلاحات الزامية دخول الأندية الى عالم الاحتراف بموجب قانون 13/05 والمرسوم التنفيدي رقم 15/73، يستوجب عليهم تبني نظام شركات الرياضية التجارية ،وهي شركات ذات هدف رياضي محددة على سبيل الحصر مؤسسة رياضية ذات الشخص الوحيد ودات المسؤولية المحدودة،شركة رياضية ذات مسؤولية محدودة، وشركة الرياضية ذات اسهم مع ضرورة اتباع شروط تَأسيسها وكيفية سيرها الفعال من اجل تحقيق الأهداف ، إضافة الى مجموعة من الالتزمات التي تحقق تنمية فعالة في مجال رياضي.

Algeria has pursued several reforms in order to develop sports in order to participate in various continental and global demonstrations and meetings, keep pace with globalization, and reach the elite level.These reforms resulted in the mandatory entry of clubs into the professional world in accordance with Law 13/05 and Executive Decree No.15/73, requiring them to adopt a system Commercial sports companies, which are companies with a specific sports purpose, are exclusively a single-person sports institution with limited liabilityA sports company with limited liability, and a sports company with shares, with the necessity of following the terms of its establishment and how it operates effectively in order to achieve goals, in addition to a set of commitments that achieve effective development in the field of sports

L’Algérie a poursuivi plusieurs réformes afin de développer le sport pour participer à diverses manifestations et rencontres continentales et mondiales, suivre le rythme de la mondialisation et atteindre le niveau d’élite. Ces réformes ont abouti à l’entrée obligatoire des clubs dans le monde professionnel, conformément à la loi 13/05 et au décret exécutif no 15/73, qui leur impose d’adopter un système deune institution sportive à responsabilité limitée Une société sportive à responsabilité limitée, et une société sportive à participation, avec la nécessité de suivre les modalités de sa création et comment elle fonctionne efficacement afin d’atteindre ses objectifs, en plus d’un ensemble d’engagements qui permettent un développement efficace dans le domaine du sport
