مكافحة الفساد كأداة لدعم شرعية النخب الحاكمة -حالة الجزائر ما بعد حراك 2019 -

Abstract

تهدف هذه الدراسة إلى إبراز دور مكافحة الفساد في دعم شرعية النخب الحاكمة في الجزائر بعد حراك 2019، حيث يعتبر طغيان ظاهرة الفساد في الجزائر وما نتج عنه من استبداد النظام وانهيار قيم العدالة وسيادة القانون وتدهور الوضع المعيشي للمجتمع الجزائري، وعدم وجود إرادة سياسية حقيقية لمحاربة الفساد والنهوض بدولة الحق والقانون، الأمر الذي دفع بالشعب إلى إعلان التمرد على النظام الفاسد، وذلك بإحداث انتفاضات وثورات سنة 2019 أين طالب بالتغيير واسترجاع السلطة من الأيادي الفاسدة وذلك بما يعرف بالحراك. ونتيجة للأوضاع الراهنة من جهة، وسعي النخبة الحاكمة وراء الشرعية التي تعتبر من أبرز المسائل التي تؤثر على علاقة الدولة بالمجتمع، وتعبر عن مدى امتثال النظام السياسي للإجماع الشعبي، وذلك بتوفر اعتقاد وقناعة لدى المحكومين بجدارة النخبة السياسية الحاكمة باحتلال مركز السلطة السياسية، وعلى النظام الحاكم تكريس هذه القناعة الشعبية باستمرار، وهو ما سعت له النخبة الحاكمة بعد الحراك من خلال الاستجابة لمطالب الشعب بمحابة ظاهرة الفساد، وقد تدخلت الإرادة السياسية للحد من هذه الظاهرة، وكأول خطوة قامت بها للمساهمة في الحد من الظاهرة استحداث مؤسسات وآليات جديدة في التعديل الدستوري لسنة 2020 ، حرصت من خلاله على تكثيف الآليات القانونية والمؤسساتية نظرا لارتفاع قضايا الفساد .

This study aims to highlight the role of combating corruption in supporting the legitimacy of the ruling elites in Algeria after the 2019 movement. The prevalence of corruption in Algeria, and the resulting authoritarian regime, the collapse of values of justice and the rule of law, the deterioration of the living conditions of Algerian society, and the lack of genuine political will to combat corruption and promote a state of law and justice, prompted the people to declare rebellion against the corrupt regime, sparking uprisings and revolutions in 2019, demanding change and the reclaiming of power from corrupt hands, a movement known as the Hirak. As a result of the current situation, on the one hand, and the ruling elite's pursuit of legitimacy, which is one of the most prominent issues affecting the relationship between the state and society, and reflects the extent to which the political system complies with popular consensus, this is achieved through the belief and conviction among the governed that the ruling political elite is worthy of occupying the center of political power. The ruling regime must continually reinforce this popular conviction, which the ruling elite sought to achieve after the uprising by responding to popular demands to combat corruption. The political will has intervened to curb this phenomenon. As its first step to contribute to curbing the phenomenon, it introduced new institutions and mechanisms in the 2020 and 2022 constitutional amendments. Through these amendments, it sought to intensify legal and institutional mechanisms due to the rise in corruption cases.

Cette étude vise à mettre en évidence le rôle de la lutte contre la corruption dans le renforcement de la légitimité des élites dirigeantes en Algérie après le mouvement de 2019. La prévalence de la corruption en Algérie et le régime autoritaire qui en a résulté, l'effondrement des valeurs de justice et d'État de droit, la détérioration des conditions de vie de la société algérienne et l'absence de véritable volonté politique de lutter contre la corruption et de promouvoir un État de droit et de justice ont incité la population à se révolter contre le régime corrompu, déclenchant des soulèvements et des révolutions en 2019, exigeant le changement et la reprise du pouvoir des mains des corrompus, un mouvement connu sous le nom de Hirak. En raison de la situation actuelle, d'une part, et de la quête de légitimité de l'élite dirigeante, qui constitue l'un des enjeux majeurs affectant la relation entre l'État et la société et reflète la mesure dans laquelle le système politique se conforme au consensus populaire, cette quête se réalise grâce à la conviction des gouvernés que l'élite politique dirigeante est digne d'occuper le centre du pouvoir politique. Le régime au pouvoir doit continuellement renforcer cette conviction populaire, que l'élite dirigeante a cherché à conquérir après le soulèvement en répondant aux revendications populaires de lutte contre la corruption. La volonté politique est intervenue pour endiguer ce phénomène. Comme première mesure pour contribuer à l'endiguement du phénomène, elle a créé de nouvelles institutions et de nouveaux mécanismes dans l'amendement constitutionnel de 2020. Ce faisant, elle a cherché à renforcer les mécanismes juridiques et institutionnels face à la hausse des cas de corruption
