حماية المعارف التقليدية في إطار قوانين الملكية الفكرية

Abstract

تهدف هذه الدراسة إلى استكشاف مدى فعالية حماية المعارف التقليدية في إطار قوانين الملكية الفكرية، ففي ظل التحولات المتسارعة التي يشهدها العالم، لم تعد هذه المعارف مجرد تراث ثقافي، بل أصبحت موردا اقتصاديا واستراتيجيا ذا أهمية بالغة، وقد حاولنا من خلال هذه الدراسة فهم طبيعة المعارف التقليدية وخصائصها، وتحليل العلاقة التي تربطها بنظام الملكية الفكرية، ومدى قدرة هذا النظام على توفير حماية قانونية لها في ظل خصوصيتها. وبالرغم من الجهود الدولية والوطنية المبذولة في هذا المجال، إلا أن وجود التحديات لا يزال يحد من فعالية هذه الحماية، سواء من حيث قصور الأطر القانونية التقليدية، أو من حيث غياب نظام دولي موحد وملزم، إضافة إلى استمرار الإشكاليات المرتبطة بتقاسم المنافع وحماية حقوق تملك المجتمعات المحلية والأصلية.

ette étude vise à explorer l’efficacité de la protection des savoirs traditionnels dans le cadre des lois relatives à la propriété intellectuelle. Dans un contexte marqué par des transformations rapides à l’échelle mondiale, ces savoirs ne se limitent plus à un simple patrimoine culturel, mais constituent désormais une ressource économique et stratégique d’une importance considérable. À travers cette étude, nous avons cherché à comprendre la nature et les caractéristiques des savoirs traditionnels, à analyser leur relation avec le système de propriété intellectuelle, ainsi que la capacité de ce dernier à leur une protection juridique adaptée, compte tenu de leur spécificité. Malgré les efforts internationaux et nationaux déployés dans ce domaine, l’existence de nombreux défis continue de limiter l’efficacité de cette protection, qu’il s’agisse des insuffisances des cadres juridiques traditionnels ou de l’absence d’un système international unifié et contraignant. À cela s’ajoutent les problématiques persistantes liées au partage des avantages et à la protection des droits de propriété des communautés locales et autochtones.

This study aims to explore the effectiveness of protecting traditional knowledge within the framework of intellectual property laws. In light of the rapid transformations occurring worldwide, such knowledge is no longer merely a form of cultural heritage but has become an economic and strategic resource of significant importance. Through this study, we sought to understand the nature and characteristics of traditional knowledge, to analyze its relationship with the intellectual property system, and to assess the extent to which this system can provide appropriate legal protection, given its unique features. Despite the international and national efforts undertaken in this field, several challenges continue to limit the effectiveness of such protection, whether due to the inadequacy of traditional legal frameworks or the absence of a unified and binding international system. In addition, persistent issues remain regarding benefit-sharing and the protection of ownership rights of local and indigenous communities.
