طرق الطعن العادية في المادة الجزائية

Abstract

تعد طرق الطعن في المادة الجزائية إحدى الركائز الأساسية لضمان حقوق الأفراد وكذلك لتحقيق المحاكمة العادلة وتصحيح الأخطاء القضائية والتي تتمثل في المعارضة والاستئناف، فالمعارضة يتم إعادة النظر في الدعوى من نفس الجهة التي أصدرت الحكم الغيابي أما الاستئناف يتم عرض الدعوى على جهة قضائية أعلى درجة من المحكمة التي أصدرت الحكم الحضوري. الكلمات المفتاحية: The methods of appealing criminal cases are one of the pillars are fundamental pillar for safeguarding individual rights ensuring fair trial standards and correcting judicial errors. these methods consist of opposition and appeal. Ces vois consistent en l’opposition et l’appel. L’opposition permet un réexamen de l’affaire par la même juridiction ayant rendu le jugement par défaut. Quant à l’appel il permet l’affaire à une juridiction supérieur a la juridiction qui a rendu le jugement par contradictoire.
