القطب الجزائي الوطني لمكافحة الإرهاب والجريمة المنظمة عبر الوطنية

Abstract

استحدث المشرع الجزائري القطب الجزائي لمكافحة الإرهاب والجريمة المنظمة عبر الوطنية، بموجب الأمر 20-04 ( الملغى ) ليعيد تأكيده في قانون الإجراءات الجزائية 25-14. منح المشرع القطب الجزائي الوطني لمكافحة الإرهاب والجريمة المنظمة عبر الوطنية اختصاصا وطني ونوعي يتحدد في صورتين، اختصاص حصري و اختصاص مشترك، كما خصه المشرع بآليات إجرائية خاصة تتمثل في كيفية اتصاله بالقضايا وكذا إجراءات المتابعة والتحقيق ، إضافة إلى ارتباطه بالتعون القضائي الدولي في عدة مجالات نذكر منها تبادل المعلومات وتسليم المجرمين.

Le législateur algérien a créé la Division nationale criminelle de lutte contre le terrorisme et la criminalité transnationale organisée par l'ordonnance 20-04 (désormais abrogée), puis l'a confirmée dans l'article 25-14 du Code de procédure pénale. Le législateur a conféré à cette division une compétence nationale, à la fois nationale et spécifique, définie sous deux formes : compétence exclusive et compétence partagée. Il l'a également dotée de mécanismes procéduraux spécifiques régissant le traitement des affaires, ainsi que ses procédures d'enquête et de poursuite. En outre, elle est liée à la coopération judiciaire internationale dans plusieurs domaines, notamment l'échange d'informations et l'extradition.

The legislator granted this division national jurisdiction, both national and specific, defined in two forms: exclusive jurisdiction and shared jurisdiction. The legislator also provided it with specific procedural mechanisms governing its handling of cases, as well as its investigation and prosecution procedures. Furthermore, it is linked to international judicial cooperation in several areas, including the exchange of information and extradition.
