Abstract

الملخص: یعتبر عقد الإذعان، العقد الذي یسلم فیھ أحد الطرفین بشروط مقررة یضعھا الطرف الآخر ولا یسمح بمناقشتھا وذلك فیما یتعلق بسلع أو مرافق تكون محل احتكار قانوني أو فعلي، وتكون ھذه الشروط تعسفیة بالنسبة للمستھلك مجحفة في حقھ، ویتمثل الشرط التعسفي في أنھ كل بند أو شرط بمفرده أو مشتركا مع بند واحد، أو عدة بنود أو شروط أخرى من شأنھ الإخلال الظاھر بالتوازن بین حقوق ووجبات أطراف العقد، ولھذا تم إنشاء ھیئات تمارس الرقابة والجزاء على من یتمادى في وضع ھذه البنود أو الشروط في عقد الإذعان. Résumé: Le contrat d'adhéssion est un contrat par lequel, l'une des parties approuve certaines conditions non négociables instaurées par l'autre partie concernant des produits ou des commodités soumis au monopole légal ou réel, sachant que de telles conditions peuvent être abusives par rapport aux droits du consommateur à travers toute condition ou clause, portant seule ou en commun avec d'autre clauses, un manquement apparent à l'équilibre entre les droits et les obligations des parties au contrat. Par conséquent, des organismes de contrôle et de sanction ont été crées pour réprimer toute partie qui exagère dans l'instauration de telles clauses ou conditions dans le contrat d'adhéssion. Abstract: Adhession contract is an agreement, by which, one of the parties approves, some non negotiable terms and conditions that are imposed by the other party regarding certain products or commodities submitted to legal or real monopoly, knowing that such terms and condition or clause is bearing, by itself or in common with other clauses; an apparent breach of equilibrium between the agreement parties rights and obligations. Consequently, sanction and control organisms are created to repress any party which is imposing such terms and conditions in the adhession contract.
