Abstract

الملخص : جاءت الآليات القانونية لضبط ظاهرة البناء الفوضوي كضرورة حتمية نتجت عن الأهمية التي تكتسيها البناءات بإعتبار أن هذه البناءات هي المأوى الذي يأوي إليه المواطن وهو المشهد الجميل الذي يغير ملامح المدينة . إذ يعد حسن وبهاء هذه الأخيرة موردا لا يستهان به للإقصاد الوطني ، ولكي يتحقق هذا المقصد لا بد من إجهاض محاولات إختراق حاجز الأمان بمخالفة قواعد البناء المنظم ، وذلك من خلال إعداد مخططات شاملة وأخرى مفصلة ،مع إجبار المعني بالبناء الحصول المسبق لرخصة البناء قبل الشروع فيه ، حثيث جاءت هذه الرخص للحد من العمليات اللامشروعة ، وكذا إجراء المراقبة الإدارية لجميع ورشات البناء أثناء وبعد الأشغال. أما فِ يخص حالة العود إلى المخالفة فهناك وسائل أخرى : وهي القيام بهدم وإزالة كل البناءات مهما كان نوعها لعدم إحترامها للأدوات الواقية والمراقبة لعمليات الإستهلاك العشوائي للمحيط.
