Abstract

The study examines the legal position of the founder member in a share holding company.

It also show that the meaning of the founder member is controversed between two tendencies; a broad meaning and a narrow one as it has been debated by different scholars that dealt with the explanation of the nature of the relationship of the founder and the company under foundation and adopted the stream that consider the later has a moral personality at the degree of foundation
