Abstract

The imbalance between economic agent and consumers , is the product of economic change and social as well as scientific and technological progress mutations. And in order to protect the consumer's willingness , as he prepares to contract in the absence of important and influential information on goods and services covered by the contract , which are necessary for the validity of the consent required to form , it became necessary for us to clarify the content of such information, and that is what is called the obligation of the contractual information . For this varied doctrine grew in determining the notion of obligation , some consider it as an obligation prior to establishing the contract and regarding the obligation of one of the contractors present in the other Contracting State , the necessary information when making the contract for the purpose of arriving at a fair and full consent based on adequate knowledge of the details of this contract because of the circumstances and considerations relating to defined nature or purpose of the contract or the quality of one of the parties . Another part of the doctrine was defined as advice or information from the applicant's contract likely to illuminate a fact or an element of the contract to enable the applicant to take another knowingly the appropriate decision . Because of this discrepancy in the definition of the notion of obligation , it is necessary to define its characteristics and this by defining parts of this obligation, the timing and nature of the obligation, its content and mode execution.
