Abstract

This article aims to study the text of Article 08 of the Code of Civil Procedure and the new management issued in 2008 and who has devoted the text of Article III of the Constitution, which decided that Arabic is the national and official language of the Republic of Algeria. Although successive Algerian constitutions stipulates Arabic language as an official language, and despite a 91-05 Act containing the mainstreaming use of the Arabic language, the text of Article 08 after nearly fifty years of independence has achieved national sovereignty in the formal linguistic significance conclusively and comprehensively in the judicial structures. The text of Article 08 cited what is new is that not only compel the use of the Arabic language in all stages of litigation, but also not to accept text documents in languages ​​other than Arabic or accompanied by a translation into the language.
