Abstract: The concept of human rights norms goes out to those rules adopted by the peoples who dealt with them over the centuries in order to alleviate the suffering and pain of humanity from injustice, oppression and persecution, whether in peace or in time of war. Certain characteristics are in common between the human rights norms and the rules of international law while some other characteristics are not because of the specificity issue of human rights. This study comes to look at the legal nature of the human rights rules, in terms of both shape and mandatory, by tracking the evolution of this nature from the stage of decisive character to the very peremptory character. This last character raises a range of legal problematic like the interruption from the international conventions on human rights.
