Abstract

The rights of victims of traffic accidents remain one of the most important topics that attract the attention of legislators, and this because of the tragedies of social and economic losses that arise from them, and if we score the Algerian legislator’s attention on the process by adopting the theory of security instead of the theory is error which was adopted before the issuance of Order No. 74-15, the increasing number of traffic accidents made drawbacks in the legislations, and the latest prevailing confusion in its application, and resulted in imbalances led in many cases to the erosion of the rights of the victims, postponed or amputated.

These manifestations require treatment starting with dealing with the legal framework for compensation, and the positive aspects that emerged from the applications, and then review the imbalances resulting from the application of the compensation process, and then submit alternative proposals to address the imbalances in the process of compensation and its reorganization.
