Abstract

الملخص: إن العقد الطبي يعتبر من العقود الجديدة لذلك نجد معظم القوانين و التشريعات الحديثة تنصعليه نظرا لأهميته في الوصول للطرق الانجع لشفاء المريض ولذلك نجد القوانين بما فيهمالقانون الجزائري يضع على عاتق الطبيب واجب الألتزام بإعلام المريض بشأن حالتهالصحية و عدم إرغامه على العلاج إذا لم تتم موافقته على دالك إلا أن القانون في المقابلنص على حالات إعفاء الطبيب من الإلتزام بواجب الاعلام في حالات استثنائيةRésumé Le contrat médical est l'un des nouveaux contrats que nous trouvons la plupart des lois et de la législation récente prévu en raison de l'importance des voies d'accès les plus efficaces pour guérir le patient, par conséquent, nous trouvons des lois, y compris le droit algérien met la responsabilité du médecin et l'obligation d'informer le patient sur son état de santé et ne pas être contraint à un traitement si elle n'est pas acceptant de Dalk Toutefois, la loi contrairement au texte des cas d'exemption du médecin de l'obligation d'information dans des cas exceptionnels.Abstract The contract Medical is one of the new contracts that we find most of the laws and recent legislation provided for in view of the importance of access roads most effective to cure the patient, therefore, we find laws, including Algerian law puts the responsibility of the physician and an obligation to inform the patient about his health and not to be compelled to treatment if it is not agreeing to Dalk However, the law in contrast to the text of the exemption cases the doctor from the obligation of information in exceptional cases.
