Abstract

ملخص :يتناول موضوع البحث المعنون"الحماية الادارية للبيئة" د ارسة الوسائل الوقائية و الردعية التي أقرها المشرع الجزائر بهدف تنفيذ السياسة الوطنية في مجال حماية البيئة.يتعرض الفصل الأول الى مناقشة الآليات الوقائية من خلال د ا رسة النظام القانوني و إجراءات حماية البيئة نستهل بها البحث حول الآراء القانونية و الفقهية المتعلقة بالبيئة، و كذا علاقتها بالطبيعة و التنمية المستدامة، ومنها نعرج الى عرض الوسائل الوقائية المكرسة لحماية البيئة لتطبيقها بواسطة الضبط الاداري البيئي.و نظر ا لعدم الحيلولة دون وقوع اختلال في التوازن البيئي فان الفصل الثاني يتعرض لدارسة الآليات الإدارية لحماية البيئة، بتوضيح الهيئات المنوط بها دور الحماية المكرسة قانونا، و الانتقال الى الوسائل الردعية المترتبة عن مخالفة الإجراءات الوقائية لحماية البيئة.Résumé: Le sujet de recherche intitulé « protection administrative de l'environnement » désigne l'étude de la prévention et de dissuasion approuvée par le législateur algérien pour mettre en oeuvre la politique nationale dans le domaine de la protection de l’environnement. Le premier chapitre discuter des mécanismes de prévention à travers l'étude du système légal et des procédures pour protéger l'environnement, nous commençons la recherche par l'opinion et la jurisprudence juridiques relatifs à l’environnement, et ainsi que leur relation avec la nature et le développement durable , y compris à offrir des moyens de prévention consacrées à la protection de l'environnement doit être appliqué en définissant l'environnement administratif .En raison de l'absence d' éviter la perturbation de l'équilibre écologique dans le deuxième chapitre est exposée à l'étude des mécanismes administratifs pour protéger l'environnement , de clarifier le rôle des organismes chargés de la protection garantie par la loi , et le passage à des moyens de dissuasion résultant de la violation des mesures préventives pour protéger l'environnement.Abstract :The research topic entitled “Administrative protection of the environment “ means the study of preventive and deterrent approved by the Algerian legislature in order to implement the national policy in the field of environmental protection. The first chapter to discuss preventive mechanisms through the study of the legal system and procedur to protect the environment we begin with research on legal opinions and jurisprudence relating to the environment, and as well as their relationship to nature and sustainable development, including to offer preventive meansde voted to environmental protection to be applied by setting the administrative environment. Due to the lack of preventing the disruption of the ecological balance in the second chapter is exposed to the study of administrative mechanisms to protect the environment , to clarify the role of the bodies entrusted with the protection enshrined by law , and a move to means of deterrence resulting from the breach of preventive measures to protect the environment.
