résumé: il est possible que l administration ait une certaine liberté d action et aussi le pouvoir de choisir le comportement adéquat dans l’exercice de ses fonctions, mais dans le premier cas, nous nous retrouvons devant un pouvoir discrétionnaire de l’administration et dans le deuxième cas, nous nous retrouvons devant la compétence liée. Hors, il ne faut pas croire que l’administration peut ignorer le principe de la légalité dans le choix de ses actes. Donc le pouvoir discrétionnaire de l’administration doit être exercé dans la limite du principe de la légalité. Abstract: It’s possible, that the administration has something of liberty of action and the power of the choosing its behavior in front of this function, in the first case, we are in front of what they called the discretionary power of the administration, where as in the second case, we are in front of the tie-up competence. However, administration ignores the principal of the legality in front of choosing these acts. Therefore, the discretionary powers of the administration have to be exercised in the limit of the legal principle.
