Abstract: Algeria is one of the countries where the party process has known a significant evolution after the one-party system phase. It wasfirst regulated by law n°89/11 issued on July, 05th, 1989, that called it political associations, reflecting political openness. Followed by the ordinancen°97/09issued on march, 06th, 1997 containing the organic law related to political parties. After the movements that the Arab worldhave witnessed in and in the middle of the political reforms that accompanied it, the organic law n° 12/04 related to political parties was issued on January, 12th, 2012. It contained 84 articles divided to seven parts, that mostly set the freedom to form political parties, in terms of its condition of formation andrequirements of accreditation, and regulated the parties activities regarding their functionality and financing. The legislative elections of May, 10th, 2012 and the local elections of November, 29th, 2012 were the perfect opportunity to evaluate the application of law n°12-04to bring out its ability to build a vigorous political scene,which is an enriching factor to the study of the legal system of political parties pursuant to dispositions of that law, and a fundamental factor to the embodiment of what should be reformulated to with a view to a sane political life, it seems that this law failed to achieve.
