Abstract

This study aims to give legal protection only booked Parliament Algerian victims of traffic accidents through the order 74/15 of 30/01/1974, amended and supplemented by of Law 88/31 31/12/1988 by compensating bodily harm.

The study resulted in the essential result is that the responsibility for traffic accidents is based on risk and not the fault may be that the person who caused the fact is known or unknown, or whatever its irregular situation as the case lapse even in cases where the victim is at fault.
