Abstract

The legislator adopted the way of EL KHOLA as a right for the wife to get rid of the conjugal life as problems that may disturb her life for different reasons. It is obvious that EL KHOLA in the family law and the Algerian justice had passed through two steps in terms of its legal adapting. First, it was given after the permission of her husband. It has been promoted to the authentic right of the wife has the right to use it whenever she wants without any restrictions.
