Abstract: The Criminal procedural law derives its importance from the fact that it organizes the state power and its institutions in detention areas, prosecution, trial and punishment. On this basis, most countries seek to ensure that their criminal law is compatible with human rights. Therefore, we wanted to show and help illustrate the importance of criminal law under the Code of Criminal Procedure in the protection of human rights by focusing on the two most important points in our opinion: 1. procedural legitimacy, its role, its importance in the Code of Criminal Procedure and its direct impact on human rights. 2. The principle of the presumption of innocence and the extent of its impact in the field of human rights and freedoms.
