Abstract

Comme cette étude vise également à identifier et clarifier les mécanismes et procédures importants qui sont légalement autorisé de la direction afin de protéger la propriété privée en termes de type de la propriété, de la propriété de l'agriculture afin de préserver le caractère agricole des terres et l'utilisation des terres obligatoire dans l'agriculture, et aussi la propriété urbaine grâce à des outils de reconstruction spécial des certificats administratifs lorsque les actes individuels d'un changement dans la propriété de biens immobiliers, ainsi que les mécanismes les plus importants et les procédures administratives afin de protéger leur propriété par la nature de la libération sous caution déposée par le propriétaire, si elle est formelle ou sans elle. تهدف هذه الدراسة إلى الحماية الإدارية للملكية العقارية الخاصة، فكان لابد من الوقوف على ما هي الملكية العقارية المشمولة بنطاق الحماية من قبل الإدارة والمتمثلة أساسا في حماية العقار الفلاحي والعقار الحضري، وكذا القيود والإجراءات الإدارية التي فرضها القانون على الإدارة في حالة تقرير وضع يدها على الأملاك التابعة للخواص إذا كان الهدف منها تحقيق المصلحة العامة. كما تهدف هذه الدراسة إلى إبراز وتوضيح أهم الآليات والإجراءات المخولة قانونا للإدارة في سبيل حماية الملكية العقارية الخاصة سواء بالنسبة لنوع العقار، والمتمثل في العقار الفلاحي وهذا بالمحافظة على الطابع الفلاحي للأراضي وإلزامية إستغلال الأراضي في الفلاحة، وكذا العقار الحضري من خلال فرض أدوات خاصة بالتعمير من رخص وشهادات إدارية عند قيام الأفراد بأعمال تغيير في ملكيتهم العقارية، وكذالك أهم الآليات والإجراءات الإدارية في سبيل حماية ملكيتهم من خلال طبيعة السند المستظهر به من قبل الملاك سواء كان بسند رسمي أو بدون سند.
