دعوى امتداد شهر إفلاس الشخص المعنوي إلى ممثله القانوني

Abstract

إن قيام الممثل القانوني بتصرفات تؤدي بالشخص المعنوي إلى شهر إفلاسه، فإنه يحق لدائني الشخص المعنوي ممثلين في وكيل المتصرف القضائي، برفع دعوى امتداد يطالبون فيها شهر إفلاس الممثل القانوني، وللمحكمة المختصة سلطة تقديرية في أن تقضي بالإفلاس الشخصي على الممثل القانوني أو إلزامه بدفع الديون المترتبة عن الشخص المعنوي. Le fait que le représentant légal des actions agit sur la personne morale la mène à la faillite . c'est pour cela que les créanciers de la personne morale représentée par l'agent de l'administrateur du district judiciaire ont le droit de déposer une poursuite judiciaire .pour avoir le droit à une déclaration du représentant légal et le tribunal spécialise a le pouvoir discrétionnaire de déclarer les procédures de faillites personnelles susmentionnées ou de les contraindre. Le représentant légale paye les dettes à la personne morale. The manager can lead the company to declare its bankruptcy because of some behaviours or decisions .For this, the company creditors have the right to allow the agent of the juridical district administrator to ask the court of speciality for a prosecute demanding the declaration of the manager ,s (the legal representative) bankruptcy. The court discretion will be depend on the financial situation of the company. The judgement can be other_ the declaration of the legal representative bankruptcy or to compel the company to pay all the debts.
